Terms of Service

These Terms of Service (“Terms”) apply to hosted Vivd access, Vivd Studio, project creation, plugin use, and publishing features provided by Vivd Solutions (“Vivd”, “we”, “us”).

If you use Vivd under a signed offer, order form, data processing agreement, commercial license, or plugin-specific agreement, that agreement applies in addition to these Terms and controls if there is a conflict for that specific relationship. Self-hosted use of the Vivd source code is also governed by the repository license terms.

1. The Vivd service

Vivd is an AI-assisted website creation, editing, and publishing platform. It can help create project files, edit websites in Studio, connect plugins, prepare builds, and publish static websites to Vivd-managed domains or configured custom domains.

Vivd is still evolving. Hosted access may be invite-led, beta, limited, or changed over time.

2. Accounts and organizations

You are responsible for keeping account access secure and for all activity performed through your account or organization. Only invite people who are allowed to work on the relevant projects and content.

If you manage an organization, you are responsible for assigning the right access level to each member and removing access when it is no longer needed.

3. Your content and published websites

“User Content” means prompts, copy, images, files, code, customer data, project assets, generated website output, plugin configuration, domain choices, and any other material you provide, create, edit, or publish through Vivd.

You are responsible for User Content and for every website you publish through Vivd. This includes responsibility for:

  • having the rights, licenses, permissions, and consents needed for the content, assets, names, trademarks, fonts, and media you use
  • reviewing AI-generated or AI-edited output before relying on it or publishing it
  • making sure published claims, offers, prices, contact details, legal notices, privacy notices, cookie choices, and other visitor-facing content are accurate and lawful
  • complying with laws that apply to your business, audience, industry, location, and published website
  • deciding when a draft should go live and which domain should serve it

Vivd may provide templates, checklists, AI suggestions, previews, plugins, hosting, or domain tooling. Those tools do not make Vivd the author, editor, publisher, seller, professional adviser, or legal reviewer of your published website.

Unless we explicitly agree otherwise in writing, Vivd does not pre-screen User Content before publication.

4. Acceptable use

You must not use Vivd to create, store, publish, or distribute content or activity that:

  • is illegal, fraudulent, deceptive, or harmful
  • infringes intellectual property, privacy, publicity, confidentiality, or other third-party rights
  • contains malware, phishing, credential theft, spam, or attempts to bypass security controls
  • unlawfully collects, exposes, or processes personal data
  • impersonates another person or organization without authorization
  • promotes violence, exploitation, or illegal goods or services
  • interferes with Vivd, its infrastructure, other users, or third-party services

You must not use Vivd in a way that causes Vivd to violate applicable law, provider rules, or third-party rights.

5. Content moderation and enforcement

We may review, restrict, unpublish, disable, suspend, or remove User Content, projects, domains, plugins, or accounts if we reasonably believe they violate these Terms, applicable law, provider rules, third-party rights, platform security, or the safe operation of Vivd.

We may use technical checks, provider abuse signals, and human review for security, abuse prevention, legal requests, and content-policy enforcement. We do not promise to monitor all User Content.

To report abuse, illegal content, rights violations, or security concerns, contact hello@vivd.studio. Where appropriate and legally permitted, we may ask for enough detail to identify the affected project, URL, content, and legal basis for the request.

Where we restrict content or an account, we may notify the affected user and provide a way to respond unless law, security, abuse prevention, or protection of third parties requires otherwise.

6. AI output

Vivd may use AI systems to generate, transform, summarize, or suggest website content and code. AI output can be incomplete, inaccurate, similar to existing material, or unsuitable for your use case.

You are responsible for reviewing AI output before using or publishing it. Vivd does not provide legal, tax, medical, financial, regulatory, or other professional advice through AI output.

7. Publishing, domains, and third-party services

Publishing makes a selected saved version of a project available on the chosen public domain or publish target. You are responsible for confirming that the selected version and domain are correct before publishing.

If you configure a custom domain, DNS provider, plugin, external embed, analytics service, form destination, email provider, repository, payment provider, or other third-party integration, that third-party service may have its own terms, policies, limits, and data practices. You are responsible for using those services lawfully and for maintaining any required account, DNS, consent, or configuration.

8. Payments, credits, and paid plans

Self-serve checkout, credit top-ups, paid hosted plans, and payment collection are not generally available at the time of this update.

If Vivd introduces paid plans, credits, usage charges, top-ups, subscriptions, external invoicing, or other payment flows, the applicable price, taxes, billing period, payment method, renewal terms, cancellation terms, refund terms, and payment-provider terms will be shown before purchase or agreed in a separate offer or order form.

We may suspend or limit paid features for unpaid invoices, chargebacks, payment failure, abuse, or fraud after reasonable notice where appropriate.

9. Intellectual property

You keep ownership of your User Content, subject to the rights you grant us to provide, secure, operate, improve, and support Vivd. This includes the right to host, copy, process, transform, display, build, publish, back up, and transmit User Content as needed for the service.

Vivd, its software, product design, trademarks, documentation, templates, and platform materials remain owned by Vivd or its licensors. You may not copy, resell, rebrand, reverse engineer, or exploit hosted Vivd except as allowed by these Terms, an applicable license, or a separate written agreement.

10. Availability and changes

We aim to keep Vivd useful and reliable, but we do not guarantee uninterrupted availability, permanent storage, error-free output, or compatibility with every website, plugin, browser, provider, or domain configuration.

We may change, limit, suspend, or discontinue features as the product evolves. Where a material change affects active hosted users, we will try to give reasonable notice unless an urgent security, legal, abuse, or operational reason requires faster action.

11. Data protection

Our Privacy Policy explains how we process personal data.

If you use Vivd to process personal data on behalf of your own customers, visitors, employees, or clients, you are responsible for determining whether you need a data processing agreement, privacy notice, consent mechanism, transfer mechanism, or other compliance step. Contact us if you need a data processing agreement for hosted Vivd.

12. Warranty and liability

Vivd is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee that Vivd output will be legally compliant, error-free, commercially successful, search-engine optimized, accessible, or suitable for a specific purpose.

Nothing in these Terms limits liability where it cannot lawfully be limited, including liability for intent, gross negligence, injury to life, body, or health, mandatory product-liability rules, or other mandatory statutory rights.

To the extent permitted by law, Vivd is not liable for User Content, published website content, third-party services, third-party claims caused by User Content, lost profits, lost revenue, loss of data, business interruption, or indirect or consequential damages.

13. Suspension and termination

You may stop using Vivd at any time. We may suspend or terminate access if you violate these Terms, create legal or security risk, fail to pay amounts due, misuse the service, or if continued service would be unlawful or operationally unreasonable.

Termination does not remove obligations that should reasonably survive, including payment obligations, content responsibility, intellectual-property provisions, liability provisions, and legal compliance duties.

14. Governing law

These Terms are governed by the laws of the Federal Republic of Germany to the extent permitted by law. Mandatory consumer-protection rules of your country of residence remain unaffected where they apply.
